stai vendendo casa? Prima di avventurarsi in una <strong>compravendita<\/strong>, per\u00f2, meglio verificare che l\u2019abitazione abbia tutte le carte in regola<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Un controllo che si deve effettuare tramite <strong>tecnici<\/strong> \u00e8 quello di verificare la corrispondenza tra gli atti autorizzativi depositati in comune, il catasto e lo stato effettivo dei luoghi<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>La casa, come si presenta, corrisponde a quanto risulta in Comune e all\u2019Agenzia delle Entrate? \u00c8 opportuno che tutto sia sistemato prima di procedere con l\u2019<strong>atto notarile<\/strong>.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Dal 1\u00ba luglio 2010, a seguito dell\u2019entrata in vigore del <strong>D.L. 31 maggio 2010 n. 78<\/strong>, la commerciabilit\u00e0 dei fabbricati \u00e8 subordinata anche all\u2019attestazione di conformit\u00e0 dei dati e delle planimetrie catastali depositate in catasto allo stato di fatto.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading --><\/p>\n<h2 class=\"wp-block-heading\">Conformit\u00e0 urbanistica, abuso edilizio e conformit\u00e0 catastale: facciamo chiarezza<\/h2>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>C\u2019\u00e8 un punto che crea confusione, ma su cui invece occorre avere le idee chiare, perch\u00e9 quando si parla di \u201c<em>conformit\u00e0<\/em>\u201d dell\u2019immobile ci si riferisce a due aspetti diversi e una serie di documenti che, fisicamente, risiedono in due posti distinti.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Una prima verifica riguarda la <strong>conformit\u00e0 \u201curbanistica\u201d<\/strong>. Ossia l\u2019immobile deve essere uguale al progetto originario depositato presso gli uffici comunali, che a suo tempo avevano dato il permesso a costruire.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Se nel corso degli anni ci sono state <strong>modifiche<\/strong> <strong>sostanziali<\/strong>, per esempio \u00e8 stato abbattuto un muro, \u00e8 stata aperta una finestra che non esisteva, o addirittura \u00e8 aumentata la volumetria, queste modifiche dovevano essere regolarmente accompagnate da denuncia dei lavori e dall&#8217;aggiornamento della relativa pianta catastale<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>In mancanza di questi requisiti, siamo in presenza di un <strong>abuso edilizio,<\/strong> che va sanato il prima possibile.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>La <strong>conformit\u00e0 \u201ccatastale\u201d<\/strong> riguarda invece la c<strong>orrispondenza tra lo stato di fatto dei luoghi, la planimetria depositata al Catasto<\/strong> e quanto autorizzato in comune.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:separator --><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n<p><!-- \/wp:separator --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>In alcuni casi, \u00e8 sufficiente la comunicazione a distanza. Altrimenti, se il Fisco necessita di ulteriori documenti, chiamer\u00e0 il cittadino per fissare un appuntamento.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>I dati che si possono correggere con questa procedura riguardano l\u2019intestazione del proprietario, i dati identificativi dell\u2019immobile (foglio, particella, subalterno).<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Occorre avere a portata di mano dei documenti, come il rogito d\u2019acquisto, per \u201ccertificare\u201d i dati che si stanno inserendo. Altri aspetti sono pi\u00f9 tecnici e non sono appannaggio del privato cittadino. Infatti, la procedura on line apre diversi \u201cpercorsi\u201d e il form delle Entrate chiede se il soggetto che procede \u00e8 un privato, un tecnico abilitato, uno studio legale, notarile e cos\u00ec via.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading --><\/p>\n<h2 class=\"wp-block-heading\">Il preliminare d\u2019acquisto e i dati di conformit\u00e0<\/h2>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>I <strong>dati di conformit\u00e0 <\/strong>sono importanti gi\u00e0 a livello di preliminare di vendita di un immobile.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Questo documento, infatti, deve contenere:<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:list --><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul><!-- wp:list-item -->\n<li>l\u2019identificativo catastale;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><\/p>\n<p><!-- wp:list-item --><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>il riferimento alle planimetrie catastali;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><\/p>\n<p><!-- wp:list-item --><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>la dichiarazione del promittente venditore circa la conformit\u00e0 allo stato di fatto dei dati catastali e delle planimetrie, oppure l\u2019attestazione di un tecnico abilitato.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><\/p>\n<p><!-- \/wp:list --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Un punto va chiarito. La situazione di perfetta regolarit\u00e0 dell\u2019immobile deve avvenire al momento del contratto definitivo, ossia il rogito notarile. Ma \u00e8 opportuno che in caso di <strong>difformit\u00e0<\/strong>, il venditore le manifesti subito e scriva nel preliminare che si impegna a sanarle entro un tempo prestabilito e che si proceder\u00e0 al rogito solo espletate queste incombenze.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Naturalmente, \u00e8 una condizione che il potenziale acquirente deve considerare e accettare.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading --><\/p>\n<h2 class=\"wp-block-heading\">Planimetria catastale da aggiornare? Ecco i costi<\/h2>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p><strong>Quanto costa la correzione di questi dati?<\/strong><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>La <strong>pratica di aggiornamento di una planimetria catastale <\/strong>comporta una spesa abbordabile. Di solito, fra dritti fissi richiesti dalle Entrate e costo del professionista incaricato, si pu\u00f2 restare intorno a 150-250 euro, a seconda delle zone d\u2019Italia.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Diverso il caso, invece, in cui si debba <strong>sanare un abuso edilizio vero e proprio<\/strong>, anche se di lieve entit\u00e0.
